Q&A - How Close Is "At or Near" for a Traffic Ticket?

Q&A ImageDoes "at or near" extend to the wrong municipality? The municipal boundary between neighboring Municipality C and D is "Street B", which has a wide grassy median dividing it. I was traveling on the Municipality C side of the road opposite to that of Municipality D written on the ticket, as was the officer and where I was pulled over.

CASE LAW - R v Yeghiyan

BC Courts Coat of ArmsSos Yeghiyan was issued a violation ticket for speeding with a ticketed amount of $196 on March 28, 2016. He paid the discounted amount of that traffic ticket on March 31, 2016. On July 13, 2016 Mr. Yeghiyan appeared before Madam Justice Adair in Vancouver and attempted to withdraw his guilty plea. He was not successful.

CASE LAW - R v Wong

BC Courts Coat of ArmsOne way of preparing for a traffic ticket dispute is to request disclosure from the officer who issued it. It was relatively rare to receive such a request but when one did appear the disputant often asked for everything, including the tread depth of the right rear tire on the police car. It was fairly clear that the request was based on advice found on the internet rather than obtained from a lawyer. Disclosing less than what was requested (but still reasonable in the circumstances) resulted in complaints to the justice at the hearing.

Q&A - Disputing No Front Licence Plate Ticket

Q&A ImageTo brief you in the story: was driving my car without a front license plate. Was stopped at the roadblock and had a conversation with an officer, who mentioned that I don't have a front license plate number and asked me to install it asap and wished me a good way. Next officer which was in 2 meters down the road stopped me too and asked me why don't a have a license plate number and issued my a ticket. I decided to dispute the allegation.

Dispute a Traffic Ticket Penalty Without Attending Court

Violation Ticket TopAre you guilty of the offence shown on the violation ticket but unable to pay the ticketed amount? In many cases you can have the fine reviewed and set to a penalty more appropriate for your circumstances without having to set foot in traffic court. When the penalty cannot be reduced or you need both a reduction and time to pay, that can be accomplished as well. All you need to do is to complete and submit two forms for the judicial justice to review.

Q&A - Late Dispute Not Allowed

Q&A ImageI was pulled up into a turn lane at a traffic light with one car in front of me. The light turned green but he did not move. I put my truck into park and got out see what the matter. He was texting.

We had an argument and I knocked his mirror off accidently by swinging my hand to motion him to go.

A Few Thoughts on Traffic Tickets

Violation Ticket TopArrest someone, fight with them, throw them in jail and see them through to penalty in criminal court seems to be business as usual for the police, but write someone a traffic ticket and it's like you've called their mother a bad name. Very few drivers hang their heads, apologize for their mistake and said hand over my ticket, I'll do better next time. Those people do exist and probably receive the benefit of a doubt more often but those that don't wind up asking me for dispute advice.
